Greg is exactly right, it's an awkward situation when it comes to measuring the fluid. In fact, it's likely that reason that the inspection includes a draining of the exisiting fluid. I suppose you could try to finagle a tool in the side hole or fill hole of the TC to guess the amount of fluid in the case, but it's not a safe method by which to truly gauge its contents.
Greg brought up a really good point; the TC holds 8 oz. of fluid when FULL! That means it doesn't take a lot of leaking to make it empty, and it's often easy to overlook.
I would def. recommend a T-case swap to some redline shockproof fluid, it should, at the very least, make it easier for you to diagnose future leaks.
Good luck everyone, and I received word earlier today from Brian of what I would consider "optimistic" news regarding his T-case. I'll let him give the story when he gets done with work.

AWESOME NEWS!!!!!
They told me that they owe me a new transfer case!! All i have to do is show them the old one(cause i told the service manager that i had to remove it to get the car on the trailer) to get a serial number off of it and im good to go to get a new one!!! Im sure they want a core too but im not 100% sure on that.
Ill probably do that on friday on my day off, this was the dealership i worked at before so maybe that helped a bit.
Big thanks to Matt C. for encouraging me to do this, if it wasnt for him i probably would have brought one used and now im getting a brand spankin new one!! Hell Yeah!!
Ill let you's know on friday the situation. Thanks again matt!!

Wow that's go to be a first most of the stories I've heard they won't do anything unless the t-case is on the car. MRink if you worried you can put the car up on jack stands with the car level just pump some fluid in until it runs out. Most gear lube bottles can use lower unit fill pumps for boats. But I would recommend drainning the fluid and filling with the synthetic of your choice.

Brian That's awesome, Brian. I'm glad things seem to be working out well. You should be certain that they T-case that they order is 25 spline. Trust me, I often hear cases of the wrong one ordered, so be sure to let them know the case is 25 spline...I hope everything in the deal continues as well as this part! Matt

As I mentioned to Brian, I'd be shocked if anything is damaged after this low speed lockup.

MR gears are only for 6-speeds. Unless you're considering getting a 6-speed, but then you'd need a 6-speed t-case because of the slight difference in gearing. I talked to Matt M about an LSD when I got my car, and he claimed it helped a (very) little with getting better 60-foot times, but the truth is, the stock AWD diffs are tuff and don't usually break. (IMHO) for $1000 or whatever they cost, you spend your $$ on something else that will help with the 1/4 times. Like a CFDS or something in that nature.
